Thank you all for the prompt responses here - this does show me some light at the end of the tunnel - hopefully its not a train coming down the tunnel towards me :)

Monkeyman - I had sent you a private message regarding the format of the letter that you had used - would it be possible for you to share that letter with me (if you are comfortable doing so).......since I know that it has worked for you.

I filed for AOS in Aug 07, my attorney advised me that we could combine the checks payable to USCIS for family members (EG: in place of one check for my 485 and one more for my wife we could combine both the checks for 485 and issue a single check for twice the amount). Based on the above, i issued 1 check for 485, 1 for EAD, 1 for FP and 1 for AP.

Now my checks have been cashed and i am able to see the receipt number on the back of the cashed check. I see two receipt numbers on the back of the checks for EAD and AP however i see only 1 receipt number on the back of the check for 485 (and the same number on the back of the check for FP)

Did any body else also send combined checks? Did you get a single receipt number or multiple numbers?

    Thanks.

Felix look at my post L C 2001 Analysts Review and you shall see how a MOFO attorney can ruin a very promising career.
If i could find my ex attorney he would beg to die.

I'm surprised that with a November 2001 PD that you are getting an interview already, since EB-3 is still retrogressed--EB3 world is only at July 1 2001 for June 2006

The PD fot EB3 is April 07 2001 I think. Anyway.... there should not be a cause for concern. The reason you got an AOS interview is that USCIS is adjudicating cases pending Visa availability. If there had been a concern then there would have been another RFE on it. You should be happy that some progress has taken place.

    Cheers!!!!!!

    Hi Charles,

Thank you for taking the time to reply. Do you think that the appeal has any chance to succeed?

The current perm was applied for senior developer. While the appeal is pending, can my company apply for a new perm for a different position like enterprise architect?

    Thanks

    Dexter,
In addition to what the attorney wrote, PERM appeals take forever. So the best would be to re-apply for a new PERM.

A friend of mine works for a non-profit and has always been with only one employer (employer A) . He had been on H1 for three years and then used his AC21/EAD card for a year now (again employer A - just wanted to save money by using EAD card instead of applying for H1 again). Can he reapply for an H1 again (same employer A again - no caps apply as this is a non-profit) or is it that once one uses an EAD card, H1 is given up forever?

    Thanks in advance

A friend of mine filed a few days before me and got his EAD a few days ago..from TSC.Hoping the July 2nd rush would not affect me by more than a few weeks. My lawyer is not able to confirm if the checks were cashed. I cannot tell if the checks were cashed either as these were checks from my company.

The lawyer however mentioned that my premium processing check may return (I-140) and my application may have gone in regular queue. Everything is speculation for now..Any one else in the same boat or can throw more light...

Thanks! It's just a modest attempt to entertain outselves with humor in these hard times.
Actually thanks to these articles and comments on BW and other forums - they are inspiration to write something witty and funny!

Are you sure that this was signed by Emilio Gonzalez and not some other Gonzalez?

I would think the last name Gonzalez would also be like the last name KIM for Koreans..there could be hundreds of Gonzalez at USCIS!

Its NATIVE INDIAN AMERICANS not 'RED INDIANS'. The term you used is considered derogatory by many.

I'm EB3-ROW and at the last stage of I-485 processing. Just waiting for the bulletin to tell me I'm current. Two weeks ago, I found out my lawyer has been blacklisted. Just like Fragomen. Apparently my lawyer performed "too many miracles."

Now I wish to change lawyers to avoid risk of RFEs, denial, etc. Should I do it? What is involved in the switch of lawyers? Just a simple G28? Any risks involved?

Would appreciate any opinions on this matter. Thank you.

Do you mind sharing the name of your lawyer?

yeah, may be you shud share the name of your lawyer....who knows I might also be using this lawyer...you never know until you find out the names.

Company B can not apply based on EB1, They have to apply only in EB2 or EB3.

To Join company b you have to use
    L1
    - not possible.
    H1
    - October 2009 possibly if you get your visa
    - Green card not in EB1
    EAD
    - Not assure. Depends on Labor, 140 then 485 filing
    Last option
    - Go to india work with them for a year and comeback in L1 and then apply on EB1 must be faster. Provided you get L1 to come here. I hear now a days they are rejecting L1s left and right.

Yes, you are right. Now that I think about it, I do remember seeing that a person can apply for their AOS within 6 months of their being out-of-status. I am in close touch w/ my attorney, and he seems to be OK with the situation, but after seeing some disturbing tales on these forums, I wanted to confirm.

Yes, but the time she was without status will count as unlawful presence (depending on I-94). No worries, only 180 days or more of unlawful presence will trigger a three-year inadmissibility ban (see the INA 212(a)(9)(B)(i)(I)).
I would also advise her not to leave the US until she gets an approval.
