Can you start residency on EAD if you are the primary for 485? Meaning, can you use AC21 and change jobs from research to residency after 180 days from filing? Please help, really confused.

Thank you; my reading of the law is also the same. However, a few of years ago (post-2001) both inside and outside counsel hired by my company came to a different conclusion. Hence, my parsing of the words.

Do you have an unexpired visa? If so, just traveling out of US and coming back through port-of-entry should do the trick. For best results, try an airline travel. YMMV.

Hi,
My parents got 10 year multiple entry US visa 2 years back. My brother who was residing here had sent the required documents and applied the visitor visa. My parents had visited me then for 3 months. Now I am planning to get my parents to US. But my brother no longer lives in USA. Is my parent�s visitor visa still valid since my brother is not residing here or should I re apply for my parents visitors visa. Any help or suggestions are appreciated. Thanks in advance.

You took this whole issue personal. I was merely fore-warning about what had happened. Since we all ( GC expectants) are going thru horrible agony, devil tricks you to circumvent the system, especially people like Dr. Ramesh.
On seperate note, citizenship can be revoked. Their are creterions for revocation, but this indian-origin doctor is not going to be stripped off his citizenship. I will certainly hope this happens to him, but I know it won't.

There is no limit on the amount of money that a person can bring in. However if a person is carrying $10 k (this includes cash, travellers check, bank draft etc) or >5k in cash then that has to be declared at customs and person should go through Red Channel.
Are there any fees that has to be paid when the amount is declared? And is this for visitors only?

I m not updating the INS regarding the Divorce, when my new wife attaends the H4, she would show the Divorce and Remarried certficate to the Consulate is that good enough so that they would take care of evrything?

Generally you need not pay the taxes right upfront, However if at the end of the year when you file your taxes, if the IRS determines that you owed lot of taxes and you hadn't make any advance payment it could create lot of issues,
Also imagine getting a tax bill for $$$$$ at the end of the year and you need to shell out right huge amount instead of making a small installments (Similar to the W2 withholdings )
Better choice, Make an advance tax payment, it would reduce the tax burden at the end, You may also get a refund.....
You can make the advance payment by getting an voucher and filling the details...., It need not be in both names, it can be just in your wife's name.
Again it doesn't matter how much you want to pay up...Pay like 3-4K per quarter and you are good...At the end of the year if you owe any additional amount you will pay it else if you made any extra payments you will get refund
All of it is just one single payment, Nothing to separate

My previous company hires them and I used to deal with Chugh firm a lot. They are very good and professional. I did not see any issues.

I applied for my I-485 AOS and EAD-OPT card for my wife at the same time (June last week) .My wife is on F-1.We decided to apply for the EAD-OPT since there were rumors of the July 2 retrogression.She received her EAD-OPT in Sep (EAD to start Oct 1 ) and received her I-485 EAD on Oct 5 (EAD to start Sep 27).
Should she use her OPT-EAD or I-485 EAD ?

I didnt send the checks,our lawyer did.So,i dont have a clue when they were cashed.
Can any one tell the time between check cleared and Notice issued. My lawyer sent the checks and he will never bother checking his account daily for me. Hence Notice is the only thing i will get.

I am a July 2 filer. I got 485 receipt notice from California Service Center with receipt date of july 2. Today, in mail, I got another notice called transfer notice, which states that my case has been transferred to Nebraska. The receipt date on the transfer notice is Sep 5. Is it nromal to have such diferent receipt dates? Will USCIS process by receipt date on receipt notice or on transfer notice?

In addition to the job requirements reading the required experience, the job description has to spell out the required experience and the job description has to justify the required experience.
Once the JD is finalized your emplyer will be sending it to the SWA for wage determination. Send it both ways and see what you get.
More importantly ensure you can get the experience letters to back the experience listed in the JD

This is really a very bad and sorry situation to be in.
I am feeling very bad after reading this.
This is unnecessary harrasment.
It is fault on your part too. They should not have overstayed and should have
filed for extension if they had to.
Best bet is to hire a good lawyer quickly.

Just got response for my SR saying there is a RFE on my case and the letter is sent to my attorney. No update or no SLUD, LUD online. No RFE on spouse case but still waiting.
