Guys..
I have been watching and participating in this drama for a long time....
We must go to court for the correct interpretation and enforcement of UNUSED VISA from ROW / undersubscribed catagories. THERE IS NO CASE FOR EVEN WAITING FOR ONE QUARTER. 20,000 VISA are available unused at a given time, they should ALL be immediately allocated to the guys in the Q.
This will benefit all EB 2 / EB 3
We really should not have any debate about loosing the case etc... Let us try and loose the case... At least , we will have the satisfaction of trying...

We had CEO of HR sign it. Here is general format.
1. BACKGROUND of Company
2. description and requirement for the position
3. AC21 compatibility explaination - 180 days etc, Job description comparision with PERM
4. Conclusion and offer for employment with salary details.
I must say in my case the salary i had in original perm was way(40%) more than i am getting on my current job due to location change and economy etc. But it seems salary didn't matter.

Thanks rajuseattle. I am first going to try find out whether my previous employer did revoke the 140. In case he didnt i am safe. In case he did, when he did it is the key.
One more thing AC-21 is not a formal USCIS form which one can fill in and send it over to USCIS, its just a letter wherein you or your legal representative informs USCIS about the change in employment, be it a job promotion with same employer or u switching the Job using the AC-21 provisions.
As explained earlier in this forum, 180 day rule interpretation is solely USCIS's descretion, if USCIS adjudicator who is working on your case accepts your new EVL and approves your case you are good to go, but for some reason the adjudicator keeps sending more RFE then you will need someone who can answer them in a legal language and thats where attorney services comes in handy.
I am hoping for the best for you that once they see your new EVL, they are satisfied and sends you GC.

Provided there is a separate check associated with that. If 485 is not filed your EAD/AP application will be rejected. Once your date becomes current CHANGE your lawyer because from my understanding of your situation either your lawyer is ignorant or he/she has pathetic attitude towards your case.

some applications have already been rejected, mostly on July 2nd but a very few.
USCIS did not say that they will return the application and they should be refilled.
With their announcement on July 17th, they have about 16 more days in this month left. It is a heavy workload for them to reject all the petitions (minimum 200K packages) which is unnecessary work and cost enourmous amount of money.
Also they will not invite another problem if the do not give sufficient time to the clients to file, what if someone receives the package Auguest 15. That will be another mess up.
It looks like SCs have rejected some applications on the same day (July 2nd), those applicants should have already received them(on July 3rd or 4th). They have to refile. Rejections after July 17th may not be true.
My lawer says:
Your application has reached INS on July 2nd and upon the statement from USIC on July 17th, it will be accepted.

Same boat as you! Legally in this country for more than 11 years! Hope they approve on time. Debating whether to extend the EAD or wait for the card
I wouldn't think of not renewing my EAD if I were you. Of course I don't know your case details, but if your EAD is expiring anytime soon, just renew it. Its worth the $380 or so you will have to shell out. Not to dishearten you (or myself) but I know someone who has been waiting to get a GC and he has a PD of Jun 2001. u never know how long it might take...

First we would like to thank you everyone who took some time off on Saturday evening and attended the event in San Jose. We also thanks Jay who came to San Jose to attend this event from Reno. The event took approximatly one and half to two hour. Majority of the People from our community left after 45 to 60 minutes. Very few people had stayed for the entire event.
There are some members who were upset and had made statements on this forum saying that the entire event was for illegal immigrants and they don't know why they went. Please note that the STRIVE ACT does not have only our provisions. The STRIVE ACT is 700+ page bill and there are several provision for other immigrant community. It will be unfair if we expect every senator and congressman to mention legal immigration whenever they are giving a speech. If the senator or congressman does not say anything about the legal immigration in their speech, that does not mean that they does not support us. Immigration Voice core group is requesting everyone to be polite and have patience.
After the event was over (as per the plan) myself and Jay got an opportunity to speak with Congressman Gutierrez. Congressman and his Deputy Chief of Staff have asked us to convey to everyone that they appretiate the effort that all our members took by making themselves available for this event. Congressman have told us that he fully support legal immigration and his bill will solve the issues that we are facing.

That is the reason I was asking you to try to find from your ex-employer if you could get any news.General procedure from what I have read is to issue a NOID but they have given you a RFE which keeps you alive for now.Maybe your ex-emplyer cancelled your 140 after 180 days but again all this is a shot in the dark and only your ex-employer has the answer for this.

hey bsbawa atleast ur pd is apr 04, now it is feb 04 for you , there is hope that you will get it by this year end atleast, think about folks like me, i have to wait till 2019 to get my eb3 to current......... so stop crying and be happy that atleast ur in EB2........ :o
lol..dont say 2019..my PD is almost same as yours and I aint hanging around till 2019..by that time I will be old and no idea what will I do with..GC..probaly hope for citizenship and apply for retirement benefits :confused::confused::confused:
