Well, I don't think I am at the end of line of 300,000 people. There must be lots and lots of people whose priority date is after April 2004 might have filed. This includes 2004, 2005, 2006 and 2007.
So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.

EB1 is more qualified than other categories and is seen as someone who is in a better position to contribute to the national welfare of the country. EB3 is the least qualified of the three and is also the most likely candidate to displace an American.
And you think America should throttle the flow on qualified EB1 and be more generous with EB3?
EB2 is different however. Most EB2 are people who were EB3 earlier (like myself). For such people, there is a provision to upgrade to EB2 through interfiling - as option that is being heavily used even as we speak. So where is the problem? I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.
What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?

Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. When we conducted D.C. rally, there were roughly 1500 people attended. Each member has his/her own reason for not attending the rally.
The reasons could be, taking a day off from work or to far from their place etc..,
As a first step��..:)
Why don�t we plan for rally on the same day, same time at various major cities? This would enable members to attend in their respective cities.
We knew that, we are 25K+ members strong and can hold rallies/protests, where we have (major cities) at least 100+ members.
We must invite media and local US leader�s for rally and show our strength and request them to work towards the Green Cards.
Why don�t we plan for a rally during the this Christmas season?
The reasons could be, taking a day off from work or to far from their place etc..,

As for handling these situatsions being diplomatic is best but that is easier said than done.
Also, I think we are much more likely to face these types of problems with small companies which are in remote areas.
Big corporations are much much better. I have been lucky in this regards that I have mostly worked with big corps.
These companies actually go to extra lenghts to appreciate diversity.
In fact last year in my current client Indians organized big Diwali festival celebrations to
give American people a chance to enjoy Indian food and learn about our culture.

Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.

I was very disappointed at infopass five months ago for 140. The person did not even know the difference between EB2 and EB3. So, I am reluctant to waste any further time. My job keeps me traveling out of town 3 days a week.
Fingerprinting for my EAD was in June08, spouse and daughter in Sep07. Is there a separate Biometrics required for 485? How do I find out about NC clearance? Thanks for your help.

I'd like to be able to say that those of us on H1B visas are doing the US a favor so we should get rewarded better for it, but I will be honest here and admit that I did not take up a job in US to be a good samaritan to Americans. I would be surprised if there were any H1B holders who moved to US just to do the states a favor.
No, in fact I like many others moved to USA because I got an opportunity to advance my career and at the same time I am young and open to experience life in America and other parts of the world. To top that I love my company.
Sure, I am helping my company and doing work that will touch the lives of millions of people. I pay my taxes. I pay my health insurance. I pay salaries to healthcare practitioners as I and my family needs their services. I pay rent. I shop. I keep money at my bank. You know, if you consider all that I must be a pretty good American resident. Smooth.
Sadly there are some things that are not so smooth. My wife, who is a graduate from a US college and a qualified teacher with over 5 years of teaching experience in her home country, has no right to work here. I hear you say, US needs teachers doesn't it? She could get her own H1B visa.
Life is not so black and white. It is difficult for her to find a compatible job in our area with an employer who could and would sponsor someone for H1B. She is chained by this. There are a myriad of teaching jobs in our area that she could fill right now if she had work authorisation.
That is the #1 reason why I am now seeking a GC. If my wife could work there would honestly be no reason for us to want a GC except maybe when we reach the end of H1B time limit if we decide to stay here longer or permanently.
We're legal, educated, and do things by the book. I'm from UK, my wife from Japan. That means just about every major country of this world is open to us (All EU, Japan and friendly countries like Canada and Astralia).
We'd like to make US our home if we are welcome. Lawmakers, hear our cries.

Simple math can easily prove most EB3s will NOT get the GCs even in 20 years. And I'm sure the concerned may want to modify it so as to make it more efficient.
Isnt it a shame that a greencard holder cannot get his wife immediately wheras H1s and others can. They have to be told very loudly. If we get used to this, then yes, there is no problem. I'm very sure immigration debate will come up in 2-3 months or later. Then 500,000 legals are nothing compared to 12 million. So lets make a strong case and educate people.. Thats my only point which some differ with me and dont want to act..

Unless they provide clear and time bound path to Permanent Residence, positive economic contributions from high skilled immigrants would be minimal.

In my case, the request was processed at the local branch. I don't recall seeing an option on ICICI to do the wire transfer. But assuming there is, you should give that a shot. You might have better luck at the branch though .... RBI has the so called KYC - Know Your Customer rules for all banks and that may give you some leeway.
Did you mean the local ICICI branch ? I would appreciate if you could let me know the process that you followed to get the money from India.

There has been established a way to deal with backlogs at Dallas and Philly, and these officials at PBEC and DBEC have been given a deadline of Sept 2007 to clear everything. So someting is and will be done in this regard. Not much more can be done here with PBEC or DBEC, and the real test is to get solutions for the retrogression.
Once the laws are passed on the immigration reforms, its a done deal my friend, and then it does not matter how much we try after this to address retrogression. This is our only chance.

I completely agree with you. However our problem is 'how do we organize a massive protest". IV is a loose affiliation of people affected by the immigration problems. They all realize the importance of fighting, however majority of them are unwilling to contribute personal time/money/energy for this cause. Flower campaign was first time in recent history, when legal immigrants showed some unity to express their anger and frustation.
It was predicted that once 485 is filed, people have EAD, and spouse working ... affected people will loose the apetite to carry on the fight. And that's what precisely took place. The biggest chellange is to let the affected people realize that if they do not come out and fight, no one will take care of their interest. It seems everyone is waiting for others to go out and fight, so that they can reap the benefits without any struggle. Now tell me my friend "how do we organize a massive protest??"

There is always some activity or the other going on in the state chapters, in fact in our chapter we organized some law maker meetings in DC this week and some members attended the meetings.
Lobbying is a very effective tool and the more the numbers and support, the more effective lobbying works out.
I would strongly recommend that the members join their respective state chapters and organize grassroots efforts.

Did you get copy of approval notice for I-140? I mean I-797 approval notice for I-140.
