So, if there are 400k pending applications and recapture can get us 215K, has anyone done some analysis on how the 215k will be divided among countries and categories?
Will this make EB2I current and EB3 I beyond say 2005?
I don't think any analysis is done. That is only going to divide the community.
Some would say preference be given to EB category benefiting EB2(I&C).
Some would say PD should be given preference predominantly benefiting EB3(I).
If they follow the current spill-over rules, as you are aware, EB category would be given preference.

i am getting frustrated to see the bulletin everymonth and it never moves.
people applied in 2006 got their GCs. one of collegue ROW got when applied in 2007.
dont know whom to blame. why cant they understand our problems.
r they least bothered.
my PD is oct 2003-EB3
Srisra,
Having PD earlier than you, I completely understand your frustration. But just talking about it is not going to help. We need to work as a team to fight this injustice. Follow all the action items.

the only way that they could find out would be based on your tax return.DO they really scrutinize to that extent?

Thanks SGP. Did I read this correctly ? you switched in 9th yr of h1 ? was ur I-485 pending or did u have EAD to change ? I just have I-140 approved. so if I change to a new job now, can the new employer use this old I-140 for extensions ? can new employer ask USCIS to port old priority date ?
floridasun: Yes, you are reading it right. I switched in the 9th yr of H1. As you can see from my signature I am yet waiting to apply for I-485. I have an approved I140 based on which I switched from Company A to Company B. The only things I had to do was transfer H1 to Company B and start New Labor. Once new labor is approved then, will have to do New I-140. You can ask USCIS for old priority date at the stage when you apply for new I-140. The new labor and I-140 can take anywhere between 6 to 8 months. Your old employer cannot revoke your approved I-140. Make sure that you have the copy of the approved I-140 before you quit.
Don't worry go for it. I know what it feels like.
Good Luck!
If you will be benefited by “I-485 filing without current priority Date”, please vote YES on the Poll.

Bulls eye. this is what I am thinking.
I am looking for an answer in general for all.
May not be 100%, I have been advised that one can switch back to h1b if there is a gap and one is on pending 485 - but may have to do stamping prior to start using the H1b - gurus can correct me here.

some time back when I had called I was told it was assigned to an officer (PD not current though). What does that mean?
I never had any RFE, but my case has been bounced around for no reason. From TSC->CSC->TSC and I am told that it is not even pre-adjudicated not even assigned to any officer as yet. I have yet to see any more illogical organization other than USCIS.

I think you are wrong... Company A can revoke approved I-140, if employee leaves them..
No problem my friend. You are welcome. I am glad I was able to help you.
Company A CANNOT revoke approved I-140. I have checked this with 3 to 4 attorneys & also with Gurus on this forum. Only the USCIS has the authority to cancel the approved I-140, if it detects that it was obtained fraudulently.
One more suggestion, ask company B to file your H1 with Premium processing. Once you get H1 approval then submit resignation to Company A.

not a single person has explicity voted "No". In reality though, everyone who has viewed this thread (1563 views when I last checked - even if you assume each person has checked this thread at least 10 times, that's about 156 individuals out of whom only about 35 have voted so far!) and not bothered to vote is essentially voting "No"! However, again as you point out, I am not really looking for the "No"s since these people have clearly decided they don't want to part with their money at this stage (not ascribing any reasons or motives here - just stating the facts). .....Cheers
Its a wrong fallacy to assume that NOs = people who dont want to part with their money at this stage. Let me put it this way for you with an example :-
Poll
1. Yes I want e-bill to save tree.
2. No I dont want ebill and I care a damn about the trees
3. Dont Care
The above poll is a loaded poll favoring one option only. Is the only reason someone may not want ebill is that they dont care a damn about the trees. NOPE. It can be a lot of other reasons - they may feel not so good about internet security or may not be internet savvy. And of course, paper bills can be on recycled paper and whole lot of other arguments are not covered.
Similarly your poll is very much loaded.
And again, you havent defined "more". Currently, I believe the contribution limit is 25 dollars per month. When you say more - what number are you thinking of. And now look at the folks who said YES. What numbers are they looking at. If you had put in a number and said "are you willing to pay x dollars per month .." - then you can be assured of that the members who say YES are on the same page as you. Right now, what you have is a number of folks but they may not be on same page.
And what is the definition of "updates" ? We are not working here on a fixed time project where the deliverable is due at the end of period 'x'. For quite a lot of period, the updates will be generic and on the lines of "we are working on getting to our goals and we are making progress". You will not get any more details than this. Turn around and check with the folks who said YES -- is this what they are expecting. Or they are expecting something different.
25 dollars per month equates to 0.6 % of annual salary for someone making 50k and only 0.3% of someone making 100k. Is this a big amount - Yes and No. It clearly depends on the individual. For lobbying you agree that the amount required is way more than what we currently are able to raise.
IV has probably 25k+ registered users. This is a good number to look at. Practically, how many of them have logged in and used this system for the last six months and three months and last month. I dont know the exact number but have a strong feeling that this number will probably in the 10-15 percentile only. And guests is not equal to an unregistered IV member. Not every person posts on this site. There are a lot of people who just browse the forums and dont post - they dont need to login everytime they come on to this site - therefore you will see a good chunk of visitors but they necessarily are not unregistered members.
Your intentions are good - but the approach you took needs to be refined further. None of what I wrote above is personally against you - I appreciate your efforts but feel that we need to approach it differently - probably equating updates with money is not a good approach given that once someone gives money , they may start having a feeling of entitlement and we may not be ready to handle it.

So does this mean I am stuck with Company A till I get Garbage Can I mean GC ?
Searched on google and got the following info
MurthyDotCom : U.S. Immigration Law (http://www.murthy.com/chatlogs/ch121806_P.html)
Chat User : Thanks a lot in advance for the kind-hearted services,
Labor/I140 approved, got 3-yr extension after completing 6yrs of H-1. If I
change my employer now, can I get 3-yr extension, and can I keep my priority
date even if my employer cancels I-I40?
Attorney Murthy : Based on the current understanding of the law and
the USCIS interpretations, one is allowed to file for a 3-year H1B with a
new employer based on the I-140 petition with another employer. Also, the
person should be able to retain the earlier PD unless the USCIS believes
that there was some sort of fraud. We have seen them grant the earlier PD in
most cases, even after the earlier employer revokes or cancels the
previously-approved I-140 petition. Many employers nowadays are choosing not
to pursue revoking the I-140 petition, especially if the employee paid for
the processing.
http://www..com/greencard/employmentbasedimmigration/i-140-premium-processing.html
Job Change - Transfer of Original Priority Date
This is not related to AC21 portability. This is very useful in a case you are planning to change jobs or you fear that your employer may be thinking about laying you off or firing you.
If the person has an approved I-140, but I-485 is not filed during priority date not being current, and decides to change the job, either with the same employer for a different job or with a new employer in a new position, the green card case would have to be started all over again, including labor certification(if required), I-140 and I-485 (or consular processing). However, if the person had an approved I-140 from the previous job, it is possible to request to retain the priority date in a new I-140 petition.
You can change jobs when I140 is approved and I485 not filed but the new employer will have to start GC process from scratch, but you can retain old PD. You can also check with attorney if you are still doubtful.
Cheers and Happy new year :)

This is the third time an Indian American has won the competition in a row.
BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.
All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.
Bullshit.

Guys,
Is this really bad news for those with pending I-140? Does it mean they expect 140 processing to be so overloaded that they can't commit to premium?
My 140/485 was filed in mid-Feb 07. Any ideas what to expect as far as 140 processing is concerned? I am pretty sure 485 processing will slow down as they will get busy with so many new applications and working on new EAD/AP applications.

When I posted that reply I didn't for once think it could be taken as anything other than a joke! If you are going through a debate in your mind whether its a joke or not, then I will have to revisit what I wrote to see what it is I am missing :)
i'll take this as joke.

If he asks for your money/car, he doesn't intend to kill you.

Would you please elaborate if the flower campaign has hit any mainstream media like CNN, Fox etc?? Or just the TOI and other small covers? I just want to know how famous this has become.. Thanks.
The flower campaign is apparently working as far as the attention the issue is getting.
If we can manage to send at least 500-700 flowers to USCIS, that will create the kind of attention we want and it will bring the issue of retrogression again on the forefront in Washington DC.
PLEASE PLEASE send the flowers to USCIS director Emilio Gonzalez. For details on sending, address and the message on the message card, read this thread :
