This is not good. My PERM labor is stuck in Atlanta, I was hoping to apply I-140 pp since my 6th year H1 is expiring Dec, 07. If I can get my I-140 approved then I'll have to leave.
1. If your labor was filed in Nov 06 or earlier then you can file for 7th year extension (based on rule that labor pending for more than 365 days)
2. I'm not 100% sure but i think when your labor is approved if PDs are current, you can file i-140, 485, EAD together and get EAD by before your visa expires and you would be fine.
3. Labor substitution will not be allowed after July 17th, and there are a lot approved labors whose beneficiaries have left the company. Employers are willing to use these labors for whatever they get (excuse me!). If you really want to stay in US, find an approved labor with PD older than Nov 06 and then file I140/485/EAD, if you don't get EAD by Dec 07 then file 7th year ext based on the GC pending more than 365 days. Hurry up for labor..

I have EAD approved and 485 pending over 180 days. But 140 is still in process. My company decided to lay me off. What options do I have ?
1. The company is not mean to revoke my 140 unless it is required by law to revoke 140 for all lay offs, Please advise.
2. What options do i have now to retain my GC process

You have a little tricky situation at hand, but you'll be okay if what you wrote is true - Your employer will not revoke your pending I-140. Not only that, they have to be nice enough to respond to any RFEs that come for your case. they can state that the imimgration application they filed for you is for a future position.
Also, USCIS has a guideline about these cases. They are supposed to see if your I-140 was 'approvable' if it had been adjudicated within 180 days or before you leave the company, which I think it should be.
I understand there are some anxious days ahead for you, but If I had to bet, I would bet on successful result of your case in the end :).
Just make sure that your old employer doesn't revoke your I-140

How about not resigning 'officiallly', but taking another job?
Most of us work for consulting companies, if we stay with the sponsoring employer for 3-4 months, then go on leave(paid/unpaid), and then 'come back' and ask for work/project.... they might not have a project just ready to take you in. In that case they may ask you to resign or else they'll have to pay you (they can't keep you on bench anymore...) or they may fire you..

They were on 'H1B' in South Africa and were treated worse than stray dogs. Gandhi fought against that and had some success.
So the idea of passive resistance DOES work in a foreign land. We are fighting against injustice. Even H1B folks have some fundamental human rights, whether we are in a foreign country or not.

Most people has very misconception about "parole". It is not a free/flexible travel document like visa. As a AOS applicant, one should not leave US till it is approved/denied. One MUST present in US during AOS. The parole is only for any emergency purpose; which is similar to prisioners. As USCIS is flexible, in approving the AP, the people don't realize the travel limitation of AP. They are travelling on AP for vatation/fun etc.. As per law, the AP is not intended for it. The CBP officer was right in asking the legitimacy of the travel. The AP document clearly says it is based on "humanitation" admission to retrun after an emergency travel.
That's correct, but what is one suppose to do when it takes years to get a green card. As someone mentioned earlier, the reality does not match the intent for the law.

I can confirm that DC allows you to renew online without looking at your immigration status. If you live in DC, make sure you renew online as I got it renewed for 4 years online.

What part of Canada did you move to?
I am from India and I have worked in the USA for the last 6 years. I have immigrated to Canada with a Job 6 months back to avoid overystaying. My experience in Canada is very bad. I am a MCAD and Sun Certifitied Developer having more than 8 years experience. I am looking for a job for more than 3 months in Canada and still not able to get a job. There is lots of racism here and people are not polite. I have been regularly applying for .NET jobs and the response is very bad. Maybe because I am from India. Try avoiding Canada as much as you can.

I spoke with IO out of curiousity to know of any update- more so to know whether my case is pre-adjudicated (as there was lot of roar on recent preadjudication). IO told me my 'NC is pending'. I told her that around this time, last year, I was repeated told on infopass and on phone that my NC/BC etc is cleared and case waiting for Visa#. She that that is true but 2ND FP TRIGGERs NC and unless they get clearance they have to wait for 180 days before my case is ready for adjudication.
Is that how it works? I was under the impression if the name check is cleared once (or rotten after 6 months) we are good. Hoping that IO gave you a wrong information.

If you had a approved 140, you'd get 3-year extensions. If it is pending, you could still get 1 year extension.
While I'm sure about this rule, you should check with the attorney.
I think its If pending...and labor approved 365 days before start date. I still need to check with my attorney. Also even if 140 is approved and dates are current i would not be able to extend.

"Depending upon where you are from, your home consulate may (most likely will) accept an application for consular immigrant visa processing. Go to the main ImmInfo.com site and read the article and other materials on "AC I-140" processing. Use the search feature if you can't otherwise find these materials.
You DO NOT have to abandon your AOS. It can continue while you pursue a consular application at the same time. When you get your green card via consular processing and return to the US, you can withdraw your AOS application at that time. Until then, it stays on file. You may use your AP and EAD while you are doing this.
We have process more than a thousand cases via this procedure. It is nothing exotic. Indeed, a substantial number of people who still visit this forum are former clients of ours who did this exact same procedure."

"Depending upon where you are from, your home consulate may (most likely will) accept an application for consular immigrant visa processing. Go to the main ImmInfo.com site and read the article and other materials on "AC I-140" processing. Use the search feature if you can't otherwise find these materials.
You DO NOT have to abandon your AOS. It can continue while you pursue a consular application at the same time. When you get your green card via consular processing and return to the US, you can withdraw your AOS application at that time. Until then, it stays on file. You may use your AP and EAD while you are doing this.

Sukekha.com is the most visited website for INDIANS in NORTHEAST....for all classifields. Would it be very expensive to put up some banners in LEADING indian websites where lot of INDIAN IT people visit.

My I485 is still pending (> 180 days filed on July27th '07). I have my renewed EAD valid for the next 2 years. I have been out of project for 4 months and my employer , who filed my GC, terminated my health coverage too. Iam using my COBRA option.
Recently, i have applied for a perm position using EAD . I explained to the client about by current status of GC. They wanted to know what they are supposed to do for it. I told them i need to 'invoke' a law called AC21.(pardon my ignorance if iam wrong) inorder to transfer my pending application.
Now the big question is, how do i initiate this whole process?

I am joining with Tek systems and they don't give as permanent position in offer letter rather just said contractor.. but I am full time with my current employer.
Do you think its going to be any problem from changing Full time to Contractor?
