Other than the trust that the core members are doing the right thing, I have no information/idea about the issues that IV core is focusing currently.
I think FOIA was a great success because the members knew exactly what IV was upto and everybody wanted to be a part of it. I believe that if IV could define several small goals like FOIA, post regular updates about the progress on the goals, a lot of people would be willing to support it.

I know I am not going to get my GC righ away by attending rallies/meetings and activity's. But there should be an efforts from every one to raise their hand and contribute for the cause. Appreciate the core members and state chapter leaders for your vision and work.
At the same note,I regret for not being at DC after meeting some of the members yesterday.
Before, I have little/no idea of how to approach lawmakers (my idea of meeting lawmakers was like meeting politicians in INDIA, Zindhabad...Zindhabad type), glad i do now :rolleyes:!
Main concern/talk was about not many people turning up with 3000 IV members in the tristate, I strongly believe we can do much better in the number department for the next meeting. Again, not just numbers but with some motivation to take part in the events to come.
I did not like the leaders thanking the members just because they turned up! It should always the other way around, members should thank the leaders for organizing such events. After all it is for ones own benefit, no one is doing a fa�vour to any one!
Come on folks, join ur state chapters.

This EAD thing is really annoying, my wife got her AP and EAD last 11/21, with immediate update in USCIS.gov. I'm still waiting for mine, and I'm the principal. Anyway. I'll have an infopass appointment on 12/18. My H1-B permit expires on 02/07/08.
We applied to NSC, all documents received on August 02/2007.

The November Visa Bulletin will almost certainly look exactly like the October Visa Bulletin. The Visa Office has already warned not to expect any movement until the CIS gets around to figuring out how many cases they have and the priority dates of those cases.

As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.40 While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. Hello ,
yesterday i was watching Cspan 2 and debate about immigration.one of the senator (i don't remember the name ) was telling about a story of a woman with six children migrated from some poor european country ten years back to America.unfortunately her husband died after coming here.She move on in life and went to idhao and opened a cattle ranch and brought up her children well.Now she is very proud and successfull business woman and mother of six grown ups whom i am sure will be well establish them selves.
i listened the story and thanked the God that she didn't came on H4 VISA.otherwise she couldn't achieve the same.
For H4 this land is certainly not land of opportunity.Rather i suggest all H4 including my wife to burn their masters in business administration degrees and PHDs ,start doing cleaning jobs like illegals and eventually apply for Z visa.
Nobody is listening to us on capital hill .H4 are inanimate objects who came here to USA to accompany their fellow husbands or wife.No matter if it is for one year or 30 years.
And in the end no reform for H4 in this bill and no hopes for getting GC to their spouse.

Although you bring up interesting discussion, but these stories about Neelima are really old. Dec 2005 ?
Did you see anything recent on her ? Any updates ?
As for handling these situatsions being diplomatic is best but that is easier said than done.
Also, I think we are much more likely to face these types of problems with small companies which are in remote areas.
Big corporations are much much better. I have been lucky in this regards that I have mostly worked with big corps.
These companies actually go to extra lenghts to appreciate diversity.
In fact last year in my current client Indians organized big Diwali festival celebrations to
give American people a chance to enjoy Indian food and learn about our culture.
Its not all bad. There are some very very good facets as well.

Hi All,
I filed my I485 in 08/05 and my labor date is 07/05 in perm. My I140 got approved in 2007.
I was in bench for around 6 months in 2008 starting from Jan 1st to 06/20th. I took full time position in last week of 06/08 and continuing in the same job. I got RFE on my I485 and asked for employment verification in 12/09. My attorney replied with presnt employment letter and applied for AC21 also at the same time. Now i got another RFE asking for last 5 years employment letter, w-2 forms and tax returns.
Can some one please let me know how i can handle the period that i was in bench in 2008.

- You already have EVL letter that states that "a permanent job -same or similar- is ready for you once you get your GC"--that is your AC21
- Your 485 was filed way before "bench period".
- During the bench period if you were only with "pending 485 authorized period of stay" (ie. not on H visa), you were not "required" to maintain employment any way. (If you were on any employment visa, you are out of status during that period).
So my advise: Just submit all the documents related to your employment history. Do not lie or falsify any information. You will be just fine.
Again, this is just my opinion. Follow the lawyer's advise.

- While on a H1 or a L1 visa, one is expected to maintain a continous period of employment. If one is on a H1 visa and does not get paid, that individual automatically falls "out of status".
- It does not matter if the person has other seemingly valid visa stamps on his/her passport.
- The only highly-skilled dual intent visas that allow one to work, are the H1 and the L1, as far as I am aware of. Dependent visas do not allow one to work, such as H4 or L2. The only way one can work while being a dependent is if one has an EAD based on a pending AOS(I-485).
- If one is on a H1/L1 and wants to switch to say a dependent visa (H4 or L2), one has to submit a change of status form (I-539?). The person is assumed to be in "authorized status" until the change of status (or even an extension) occurs. If the COS or extension gets denied, the person is retroactively "out of status" from the original date of expiration on the previous visa.
- Accruing over 180 days will entail a bar of 3 years for re-entry after the person leaves the US.
- Accruing over 365 days will entail a bar of 10 years for re-entry after the person leaves the US.

Under the current system, unfortunately, there is limited employee protection or even whistle-blowing, so seek a competent attorney's advice right away.

Consulates in third countries do not entertain applicants for visa stamping or visa renewals if they have not maintained status.
- If the home consulate approves the said individual's visa renewal or new visa stamping, that individual can enter the US, however, there is lack of clarity on whether such a person will be finally able to "adjust status" to become a lawful permanent resident.
This is a SERIOUS matter requiring legal competent advice.

Come on folks participate in this poll and drop in for the meet. If I can make it to the meet by commuting for almost 2 hrs (one way) what is stopping folks who are working few subways stops away from penn st or GCT :confused:
