Can somebody answer this question of mine please.
If you are efiling it will automatically assign you the service center that you should be filing to. Better shoot for that to avoid any issues.

I tend to think a point system is better than what we have now. One thing though is that the points should be allocated "properly". For example, more points should be given to people with higher education, who earned a US degree, who have worked in the US for more years, who have paid more taxes, etc.
Someone mentioned a good point is about the visa number limits. If the per country limits are not eliminated, the points system won't solve the problem. Of course, they should also give more points to people who have passed Labor and I140 and allow them to adjust status right away. Otherwise, we will further get stuck in all the backlogs. Poor us. :(
I think if all the above issues are solved/cleared, probably a point system is good for us (i.e., EB based immigrants who are now stuck due to backlogs and retrogression). :p

With this rule in effect from july 2nd, what happens to the cases filed before in PP but it is in pending status with an RFE.
I had received RFE on my I-140 on June 1st and replied back on June 6th but there is no update since then from USCIS.

Why don't you do this? Try to search just for your employer - and once you have a bunch of cases filed by your employer, go ahead and narrow yours down based on Priority Date.
I do have the Employer and Attorney details. I searched based on that. Reg, case number, which case number we have to use, the backlog center number or any other number? I do have a copy of the approval letter received from backlog center.
Let me know what else I can do?

AND ONE MORE THING. THESE PROCESSING DATES ARE FOR RENEWAL APPLICATIONS. NOT FOR NEW APPLICATIONS. FROM MY EXPERIENCE I SAW FIRST TIME FILERS ARE GETTING THEM IMMEDIATELY THAN RENEWALS WHICH WERE TAKING 2-3 MONTHS.
It does not anywhere say that this timings are for renewal. I have my 3rd EAD now. Everytime, I got my EAD approved based on processing times given in the web site. I found one difference, when I filed my 1st and 2nd EADs at California, I got them in 1 month(but again based on processing times). Now the 3rd one, I got in 3 months(again based on processing times)

We all have only 1 thing going on in our mind where every we go & what ever we do is about GC when it will arive. You see this offer & that offer. What you do ? nothing. Because you dont have EAD :confused: or GC :confused:
So now is the time we all can get together start our effort. No one knows about the result. Atleast some day some one will hear our voice.

If you really look at who is paying less and misusing the H1-B and L1 to manipulate the job market, its the big offshore companies who bring the less experienced folks from India/China and other asian countries into US. These biggies pay way too less (52 to 57K) to these folks than what the conultants who work for local consulting companies make.
They apply for 1000's of H1B's and L1's showing the positions in US but 60% of the folks works back in their offshore centers in China or India with H1B/L1 stamped on their passport. Question is, if they applied for H1B / L1 based on an existing position in US and gets approved, why is that folks are still working in India or China center? Doesn't that mean they faked the position?
When we consolidated the vendors and excluded all the local consulting companies to include only two of the big offshore companies, we have seen their consultants brought onsite leaving them after few months at our group to join local consulting companies for better pay.
To me, they manipulate the job market displace americans much more than the local consulting companies.
I truely hope CIS look deep into these manipulations and frauds as well.
I think the unlimited number of L1's has been a 'bane' for the employment market here as they 'definitely' replace the American jobs.Again this might fit in to the company's strategy and I m no one to complain about it. I am sure most of the other consultants on H1B in this country do make decent enough ( > 75k ) to qualify for the wage bracket that is being applied as a statistic here. The fact is though is that the employers do advertise lower salaries for the positions there by creating requirement though they might be actually paying the employees more than the advertised salary.

Who said the position must be in zone V only to qualify for EB2?
For the position to be qualified for EB2 it must require MS. For position requirements to be considered "normal", they must fit into the respective zone in terms of SVP level. As I learned from my bitter experience, though offficially for a PERM to be approved the requirements don't have to be "normal" (if they are not, you just need to supply the "business neccessity" letter), it looks like the current PERM's software just doesn't have such possibility "in mind" and automatically denies the application if the total education plus experience requirements exceed the SVP level for the zone corresponding to the position. You will get a denial notice which will blatantly claim something like "By answering YES to question H-12 you have attested that the requirements are normal, but the total SVP level exceeds the normal level for this position..." even if you have answered NO to that damn question! Therefore I don't recommend to exceed "normal" SVP level for the corresponding position code.
However, if a suitable code falls under zone IV, nobody (except for emplyer himself maybe) can prevent the employer to require, say, MS plus 2 yrs of experience. And it is within "normal" SVP level for zone IV, and it does qualify for EB2 (because it requires MS).
