What is ur PD, Diptam?
hey aadimanav,
If the legislations dont change - my estimate would be even more than
7 years (come on they already have 500k pending app before this 300k
July2nd boom).
What Franklin said very logical - very realistic !
Thanks,
Diptam

Did anyone of you use AP to come back and the name is not correct, i have a situation where my
middle name is missing one alphabet and i am worried if that would be an issue while coming back from India.

My wife does not ahve paystubs from Oct 06 to Dec 06 and no W2 for year 2006. SO I would need a absence letter. Any for mat of letter would be appreciated.
We have paystubs from jan 07 to Jun 07 and plan to leave in July after filing 485 and plan to re enter in August using unexpired H4 visa.
I know of someone who used unexpired H4 visa in spite of being on H1 before leaving US
Any issues with above scenario?
What is the approval date for her H1-B?
Using unexpired H4 visa for re-entry is no problem. At the time of entry in US, it does matter what status you were on last visit as long as one has not accumulated > 180 days in unlawful presence (i.e. stay beyond I-94 date).
Not a legal advice.

Hi Ragz4u,
This is THE time to stop answering negative mails, and convincing chronic doubters. It definitely distracts. Maybe until the bills gets to voting on the Senate floor, we should all unilaterally stop spilling out our doubts and apprehensions on to the forum. Any serious chronic and obsessive doubters should write a PM to Ragz4u or any other internal contacts.
Now, coming to more useful part: Many of the universities and research institutions employ chinese and Indian postdocs and researchers on H1. Many of them sponsor GCs via EB2 and rarely EB1. Although many members here in the forum are under EB3 (isn't it?), the retrogression affects both EB2 AND EB3. The catch is, these institutions come under (many of them if not most) a category called non-profit, no cap etc. Looks like they cannot, as institutions, lobby against retrogression. I personally tried to do this in my institution but I was turned away; also my institution is very small unlike for example: University of California schools, or University of Texas schools. In all these institutions, the affected researchers work for individual Nobel laureates, accomplished professors (both chinese and Indian origin AND native born Americans) who can support the efforts. That requires a nodal point for information exchange. One side, IV can do this and on the other end, there are somethings called: postdoctoral fellow associations in many universities.
They are cataloged at: http://www.nationalpostdoc.org/
It will make more sense for an organization like IV trying to convince NPA to raise this issue than individuals like me. I have been in science for 14 years and I say from my experience.
There are two renowned science journals that talk about career issues.
The journal Science www.sciencemag.org has a portal called NextWave that deals with career issues of scientists. They frequently write about many visa issues but they need to be dealing with a resource to write about retrogression etc.
http://sciencecareers.sciencemag.org/
Another equally good portal belongs to Nature journal:
http://www.nature.com/naturejobs/magazine/index.html
Eveybody talks about retaining best talents back in US but there is no support heard from academic communites on this. So instead of answering
chronic doubters, IV should try to reach out to these organizations.

No, the horse bill is done. They continue with the immigration for military families
King will, as usual, will come up with alot of amendments again. By the way, they have to finish with the horse bill and then they will come to our bill and then they have to finish the nurse bill. All the bills along with the Mr.Kings amendements have to be done in 2hrs because it starts at 3PM and ends at 5PM.

Read the instructions on the I485.
You might only need a receipt notice for the I140 to file I485.
Makes sense since you can concurrent file I140 and I485 anyway.
I filed I485 two months ago, and seem to recall reading this on the instructions or elsewhere.
I would also do AOS not CP.

Hi John, thanks for bringing this to the attention of our members. Lets hope everybody finds time to call Sen Cornyn to thank him for introducing this bill. Another thing I wanted to say is that, our members are all busy with 485 filing and stuff so we can expect a response only after the 17th of August when the excitement of 485 filing is over. Even though it was defeated it doesn't seem to be a very hated idea by the majority since 5 more votes would have made it safe. So there still seems to be a positive factor lingering around for us the "legal immigrants". Hope we are able to capitalize on it soon. IV is infact becomming stronger and more influential thanks to the dedicated efforts of the leader and the members. Pls keep up the spirit for all of us. We need vigilant people like you to do the work to spot opportunities and failures for the community. Thanks.

The applicants green card application has been pending since early 2005 due to the FBI name check. The applicant is a valued researcher at a U.S. pharmaceutical company. (page 39)
The applicants green card application has been pending with USCIS for approximately four years due to the FBI name check. The applicant is a researcher at a U.S. university and, because of the adjudication delay, the university and the individual have been disadvantaged in seeking grant proposals and funding. Specifically, the individual reports that he is currently working on federal research projects. The applicants inability to advance critical work for the project is a serious impediment to the university, its competitiveness, and the applicants professional advancement. (page 39)
In early 2006, the applicant applied for naturalization. USCIS informed the applicant that the application is pending due to the FBI name check. The applicant currently is a contract employee for a federal agency and was security screened prior to beginning that employment. (page 44)
The applicants green card application was filed in early 2004. The application remains pending due to the FBI name check. The applicant previously served as a security officer at a U.S. embassy and was subject to rigorous security screening for the position. (page 44)

This is an amazing forum, and I would like to thank you all for the useful information.
I know, it's going to be a long journey, but a start would definitely help.
Thanks, :)
You may have an alternate option without taking the MS...
See the following link: RAMPS International INC. - Immigration Information (http://www.rampscorp.com/immigration.htm)
In the case of H1 it says: "....An accredited United States evaluation company can provide an evaluation whereby three years of progressive work experience are considered equivalent to one year of college education in the event the foreign national has only a three year bachelors degree....".
So, I think it is really worthy to explore whether it is possible to convert 3 years of experience into 1 year equivalent of education.
I do not think, you really need to take an MS to be considered for EB2. Contact Murthy law firm, I think they will definitely be able to handle difficult cases like this.
Or else, you just take a 20 minute appointment with one of their experienced lawyers and they will be able to give you a firm answer. It costs somewhere between $150 and $250 for a 20 mt appointment.

Let me take a stab at it:
EB2 I - June 2006, EB2 C - Dec 2006
EB3 I/C - Dec 2003
I'm guessing with fewer jobs available for next year, there will be a huge leap - EB2 may move to 2006 and EB3 to 2003...this is just a guess, an attempt to speak things into existence :)

we have close to 200 votes... I never imagined the % will so much higer..... around 80%...
Thanks again.
Those 80% who bought homes, a whole lot of them have been able to survive because of the July 2007 fiasco. Without EAD it would have been a totally different ballgame.
Also a lot bought home in pre-credit crisis era when 5% down etc was available. But now 10% or if not more is the norm. So you will have a lot to lose if you default or leave country.
A friend of mine who got GC in end-2006 was discussing with me in 2008 whether to buy or not (he did not buy at that time...I don't know now in 2009 whether he has bought or not). The reason is that just because one has GC does not mean one has to commit stupidity when prices were plunging.
One needs to weigh all options. I see no GC in the horizon for EB2/3-India for non-EAD people. The political equation is stacked against EB2/.
House prices wont recover for many many years. The early 90s correction took a decade to recover.
If you are not on EAD and your pd is in 2006 or later, then it makes no sense to buy a house financially (though it is a ok time if you have EAD/GC but can wait more).

Apparently someone flagged me.. thats fine.. if people here cannot have a proper discussion without having to flag each other I dont see any point in calling ourselves "smart" "highly skilled".. looks like we need to grow up first. Personally, I dont care about these green/red blocks. I have the right to express my opinion whether someone likes it or not. If someone does not have "words" to argue back thats their problem..
