often times i have noticed that the blissfully ignorant GC applicants come better off than rest of us- who act like chicken with the head cut off after every bad news!!! may be they dont worry too much and look at it from a whole another perspective...who knows...i wish i could be one of those, but i am too far in the game...damage is already done...:D

I agree, FP does not have anything to do with namecheck. I never received my FP for 15 months but inbetween when I took infopass - it was confirmed that my name check was done
I was under the same impression that it was FP that triggered the name check. But this is what the lawyer told them that their names were struck in NC and that is why they never got FP and now that NC is over they received FP notices. The interesting part is that within 3 weeks of FP one person got a notice that his application has been sent to USCISlocal office for further processing which I assume means interview notice in few days.

What kind of charges may be filed under the following points?
1. Processing and approving 60K I-485's in 2-weeks (12 times normal speed) just to avoid the flood of applications in July, when you consider that their typical speed is around 10K/month. 25K applications were approved in just 2-days (37.5 times normal speed) over the last weekend.
2. USCIS requested visa numbers for cases where FBI background check was not completed. In other words, they requested numbers before processing could be completed for those cases and I-485s could be approved. Serious issue of lapse of national security here.
3. USCIS apparently approved I-485's of some people whose dates were not even current in June, even if their FBI check had been completed and I-485 otherwise ready for approval.
4. USCIS apparently approved I-485's of some people in July after DOS published the updated visa buletin on July 2nd advising that all visa numbers were exhausted for FY 2007.

Pre-adjudication where work continues irrespective of visa # availability (where everything else is done except visa # allocation) happens as per the RD of the I-485.
Now even if gc101's I-485 get's pre-adjudicated sometime next year w/o PD being current his I-485 is not "approved" unless visa # is allocated. Now suppose his PD becomes current after his app. is pre-adj., he has very little time to add the spouse name as there is chance like in June that they may quickly assign the visa # and "approve" the file in days.
So gc101 would be safe if his PD becomes current before his file is pre-adj or get's stuck (!) in something like FBI namecheck after pre-adj. which might allow him time to add his wife's name.
My company lawyer addressed this part. The way it works is that they will work on your file only when your PD is current. So even if you apply now, they most likely wont work on it after July as your PD wont be current. Then when next time (say in Jan 2008) when your PD becomes current, they will pick up all the files for that month and start working on it. It might be that they will work on your file on Jan1st or Jan 31st. You can send your wife AOS the moment your PD becomes current. So you want to make sure that it reaches there before they approve your AOS. In case you are extremely unlucky, then they would start working on your file on 1st day of the month and finish it before end of that day, making it impossible for your wife's application to go through. Thats rare though. So if you can make sure that her app reaches on 1st day of the month in which PD is current, then they should most likely add her to your AOS and work on those together and make your life go forward....its a chance which you will be taking...But again life is a chance

My lawyer advised against filing AC21 proactively. His opinion is that it may trigger a big RFE requiring financial details of the new employer. How true is this? I have a feeling my previous employer might withdraw my approved I-140 on the advice of their corporate lawyers (Fragomen, who I believe recommend I-140 withdrawal as past of their standard procedure when an employee leaves). I would like to preempt that and file AC21 documentation.

USCIS has specified that they would have processed all the records into a single database by 29th October.
Does this not mean that there could be a forward movement in the Nov bullietin ?

Is there any Specific date, I mean when AILF is filing the case...USCIS is announced they are gonna reject the applications..but did they rejected any single application?? We will come to know after 4 or 5 weeks abt our applications (As per USCIS rep)....I think there must be some time limit to file a case...and we dont have a base to file a case until they reject it.

You will also see "Approval notice sent". It means the card is on the way to your mailbox.
I feel for all of you whose EAD is not yet receive. When my EAD was pending for more than 90 days, I wrote an email to the Ombudsman. I don't know if it helped or not. I just got RFE notice 4 days after sending the email. After replying to the RFE (photos), I got my EAD with no problems.

Are you willing to put your name in a lawsuit, travel personally spending your own money to the courts, stay up late and do the research with the lawyer and above all spend hundreds of thousands of dollars on expenses of a lawsuit?
When people cannot contribute $25 how can you expect them to contribute 100K+. Even the FOIA campaign 10K amount took about a month to meet. So no point discussing something people cannot do. Let us just focus on writing forum posts. This is the easiest work we can do and it does not cost us money.

Generally most companies are comfortable doing a 1099 on Corp to Corp than doing a 1099 with an individual. In both cases it is 1099 and company pays $$ as agreed.
There is one major difference why companies want to do business with consulting firms rather than individuals as the perception is when doing business with a firm as opposed to individual you deal with so many people (not just one) who share the responsibilities. If for some reason things don't work with the consultant the company can request the consulting firm to provide substitute so on so forth.
Also firms are perceived financially Strong, can afford $3M+ insurance (just in case something goes wrong) while individual may not be in similar position
it is always better to go with a Consulting firm rather than going individually (Pros certainly outweigh all the cons)
If you have a GC you can incorporate your own company and work ( If you are ready to take additional headache, If not better work for a consulting firm)

I spoke to a IO from Nebraska center ,they said my data is not in the system.She said no memo has been issued how to process the July 2nd cases,but they will process all the other cases according to VB 107.when i asked more she said she cannot give me any more information i asked her should i resubmit , she did not comment on that i was totally surprised when i asked her when the cheque will be cashed she said october, I again asked her and told her it is not for H1 b it is for I 485 again she said october.Did you any of you guys call the USCIS ??

Just work for those 6 H1B yrs and get the hell out of this country. Dont make a fool of urself and others by saying things like "at this moment" hez a citizen of another country blah blah blah...I know a few friends who just love India and would wanna go back after earning dollars for those 6 yrs H1B lets u work for. I appreciate such ppl...not ppl like u who try to "show off" that they r citizens of another country by shouting slogans and at the same time apply for permanent residencies with other countries...SHAME ON U PPL!
