I changed jobs after 5.5 years on my H1-B. When the new company filed for H1-transfer i got approval for 3 years based on the I-140 from the previous employer. In this case there was no need to apply for extension, while transferring the visa, I got 3 years. Send I-140 and Perm copies along with the H1-Transfer

Mu I140 was approved back in May /07. I got a LUD today bit I don't know what it means. I have the receipt notice of my I485. I also got LUD on my I131 for me and my family.

My case EB3 PD Jan 2004
I40 approved TSC July 2007
485 filed at NSC July 2nd

LUD is 8/12/2007

Does this mean anything ?

I don't think he is here to be tried in public by idiots like you. Why is this site full of self righteous punks who reply back to put others down. I saw similar set of replies for a woman who sought help regarding her status for entering the country without passport from Canada (which was legal pre 9/11) and then divorcing the dude she was married to. Some righteous pricks called her names and gave red dots generously.
Seriously if you don't have constructive advise just keep your mouth shut. Nobody needs you to bring your vigilantism and judgement ion other people. A few too many pricks are the reason a lot of us get turned off of this site.
The OP needs some advice irrespective of how he got to this situation.

Hello,

I have a same question. I have my EAD but my h1b is expiring in decmber 07 which i am not planning to extend. So do I need to take my EAD and current employment letter to DMV along with tons of other documents to prove the residence status.

Please respond if anyone has done the same.

They'll probably start with what Senate passes. and make some minor amendments.

If it passes the house, conference will be piece of cake.

Our best hope is:

1. When senators return to the constituencies for the memorial day recess, they receive a LOT of negative feedback about CIR and enough number of senators change their minds and vote in -ve and bill fails to make out of the Senate. Likelihood: 10-20%.

2. House of reps votes on this CIR and defeats it. Likelihood: 40-60%.

I hope one way or another, this piece of crap fails and I happily get my GC in another 5-10 years. If it passes, I'll have to pack my bags. Amen.

I haven't come here for a while and don't know what's happening here. Several weeks ago, we said we would be happy if congresses pass CIR. How come we don't want CIR to be passed now?

looks like employer failed to file updated LCA,i am not sure if an updated lca WILL HELP.

Since its not the beneficiary's mistake, your brother could either try to apply for a H1 through a new employer (preferred) or could try to apply for H1 again with the existing employer and then have her wife attend H4 interview again once its approved. Chances are that your brother might get the H1 approval without an attached I-94 so he will have to attend a H1 visa interview in the home country before starting work again. So they might end up attending H1/H4 interviews together.

I always enjoyed the Hyatt at Embarcadero Center and would probably stay there......If we are talking sometime in December I would hope we could firm up some dates soon so reservations can be made....Example if we made a date for Sat December 10th weekend I would arrive sometime on the 9th and then leave Tuesday 13th or Monday 12th.

I also may consider a round or two at Peeble Beach/Spanish Bay not to interfere with our weekend, but afterwards.

His lawyer was right. If he has H1 he can do H1 transfer to another employer and invoke AC21 to continue AOS.

I see, so that means if i have to invoke AC21 i do H1 transfer. But what if the other company don't want to do H1? Then i guess working on EAD is the only option.

I asked a question regarding use of AP and received following response from Embassy of Belgium.

Dear,
As an Indian citizen you do not need a transit visa IF you are only making an airport transit (in other words, if you stay in the airport terminal and you do not have to re-check your luggage in Brussels ). Please contact your airline to make sure your luggage goes directly to your main destination.

Also Confirmed with JetAirWays NY. They said that the plane stops for 2Hr for security check and there is no check out/in. So I dont need transit visa.

An I-140 has nothing to do with I-485, except to the extent that an I-140 has to be approved before an I-485 can be approved. So I-140 approval is must before an I-485 can be approved. Further, an I-140 is not related to the priority date - An I-140 can be filed any time once one has an approved labor (Assuming, of course, one is applying in EB2/EB3). But I-485 can only be picked up for processing (or even filed) if the priority date is current.

If your I-485 date is not current, it does not matter what you do about your I-140. The question about affecting I-485 is irrelevant if your priority date is not current, which is the situation now.
(USCIS is accepting I-485 applications now until August 17th even though the priority date - the visa availability, in short, is "U", unavailable - but that is a rate exception, and does not affect the actual processing of I-485s: 485's applied today will NOT be processed even if accepted, until the visa bulletin says visa numbers are available for your priority date)

Confusing? I'm afraid it is.. but anyway, the short answer to your question is, no. The people your refer to likely have applied I 485's earlier (say in June or earlier), and their fast approval is likely for different reasons, other than premium processing for I140.

I did my address change last month and got soft update...my dates are also current.On friday I got a notice from USCIS for biometrics...don't know what triggered it..still waiting for the biometrics notice for my family.

GC application is for future employmnet - so u can theoritically not join ur employer until ur GC is completely through. But how many employers will be willing to take that risk , esp. mom-pop shop Consultancy firms.

I came here as student and OPT before, the OPT had a A number

In my approved I-140 i had a A number, both the numbers are different

While filing the forms for 485/EAD/AP and I-693 ( medical report ) i saw a field for A number

Which number must i put in the field

Do you have I-140 approval notice with you? If so, A# is going to be there just above the Beneficiary name. Nowadays, USCIS is assigning the A# when they approve I-140. This is what i got from my attorney Rajiv Khanna. Do not listen to them who says it comes only when I-485 is approved. Once I-485 is approved, there is no need to have A# number otherthan you want to apply for Citizenship or keep it for records. So, it is useful only while applying 485 or EAD or AP.

Sorry Man I never posted a reply to the substituting for gradients. But your latter image was much better with image swap (instead of gradient). Doing your navigation in flash would be an excellent idea (instead of mapped images). I am thinking of writing a tut on how to make better gradients without using gradients....you think peeps would be interested? This technique has produced astounding results for me....I am trying to work on the grunge thing I jsu cannot produce anything cool....by the way me2 is very cool.

I called Cornyn's office just now - male staffer got really annoyed when I
asked him if Senator Coryn supports displacing well-educated American
workers with Foreign H-1B Visa holders. He immediately passed me off to a
voice mail box of a staffer who handles immigration matters. (Yes, I know
H-1B's are so-called "non-immigrant Visas" but we all know most of these
people end up staying here -)

Of course the staffer did not pick up his phone - but the staffer's name is
Landon Bell. Why not ring up Senator Corn-Hole's office and ask for Landon
Bell, and ring Landon's bell a bit?

person I spoke with said that Cornyn was trying to get his bill introduced
today, and he was not sure if it would be voted on today.

Maybe you all have different information that I just obtained from both
Senator Pete Domenici's office (Republican) and Senator Jeff Bingaman's
office (Democrat) -- both of New Mexico. But both of their offices claim
that Skil Bill "Access to High Skilled Foreign Workers" S 2691 has NOT left
committee yet and thus cannot be voted on yet. (It is certainly possible
that you all have different or better information than was conveyed to me
but this is what I obtained.)

Domenici's office staff person couldn't tell me which side of the fence he
was on as he hasn't "made a press release" yet. And, as long as it is in
committee he apparently doesn't voice an opinion.

Senator Bingaman's office staff also told me that he had not expressed an
opinion to him on his position on the bill. The young, female staff woman
who answered the DC phone seemed STUNNED when she pulled up the bill and
started to read parts of it. She thought they'd have to take some kind of
special test to get into the USA for these jobs -- no. I only wish she
were casting a vote as I know how she'd vote! Again, she told me that
the bill was not out of committee YET and the Senators are going home
tomorrow afternoon. They are doing "yesterday morning's" work tonight or
some such backward thinking. There has been no floor debate on the bill so
the staff claimed would mean there will NOT be a vote on the bill tonight.
No one would guarantee me that NO voting would take place tomorrow but did
say it was UNlikely.

Finally, when I got to the staff woman in DC she was a bit surprised
because someone had called her on the bill from one of the Senator's New
Mexico offices. (A bit strange unless it was my calling the Senator's 800
number which connected me some place in New Mexico and they called the DC
office for information regarding my inquiry.)

(BE careful when you call, however, one Bingaman's staff males that I
spoke with tried to give me the WRONG Senate Bill number reference. He
asked "This is Senate Bill 2626?" I said "The one I am calling on is
"Senate Bill 2691 "Access to High Skilled Foreign Workers" so unless the
bill has been reassigned a number that I don't know about -- I am calling
on the Skil Bill "Access to High Skilled Foreign Workers.")

Oh, yeah! the woman from Bingaman's office said "Oh, THAT's a
Republican sponsored bill!"

I, too, phoned Cornyn's office and the person I spoke with kept insisting
that the H-1B's had to be paid the same as Americans and then he said the
senator wants to make America more competitive by bringing in skilled
workers. I directed him to Norm's article in the San Francisco paper and to
the Programmers Guild. I asked him how it would make our nation more
competetive to bring in a worldwide supply of cheaper labor to take our
jobs. Silence.
