Now that Democrats have taken the house and will soon bid adieu to rabidly anti-immigration Republicans in key posts like Sesenbrenner and Hastert, it does bring in a new ray of hope for us.
What this means for us in two houses:
Senate:
- To get anything done in the Senate, a bill needs support of more than 60 votes.
- Even if Democrats control Senate, which we will find out after a Virginia recount, they will really have to work in a bi-partisan manner. If we look at past trend the Senate was open to immigration reform.
Lower House:
- Due to "majority of the majority" rule by soon to be former house speaker Hastert, NO non-conservative agenda saw the light of the day in last congress.
-This effectively turned into a do-nothing congress.
- New Democrat speaker Nancy Pelosi brings hope for millions.
- This is a good chance for Bush to show what he can rally around all Americans not just the conservatives.
This election has shown that the American democratic system does work and that there is still hope for immigration reforms.
Maybe, this is too early to celebrate but I will go out and have an ice-cream :o some good news after a long draught

This is all time low for "Highly Skilled" "Highly talented" "High INCOME" group. For the issue that affects our life the most, we are asking IV core if we could still drop to $10/month or $1/month, realizing well that we are up against well oiled and very well funded machinery of anti-immigrants. WOW!!! Is there a competition going on as to how low this community can go?
This issue affects our personal life, family life, professional life, careers, professional life of our spouses, development of our growing children and still we cannot even come up with $20/month. After reading this, not sure whether at this time I am filled with more shame or is it more anger that is bothering me. Anyways, either of the two are lowest energy levels in human behavior.
The amount of money we contribute is the measure of importance of this issue for us. Is this issue worth $20 or $10 or $1 for us? I guess the answer is NONE. This issue drives our life and we cannot come up with the necessary resources. Shame. We are expecting Amitab and Shahrukh to raise money for us when we do not want to help ourselves. I know I am not going to get my GC righ away by attending rallies/meetings and activity's. But there should be an efforts from every one to raise their hand and contribute for the cause. Appreciate the core members and state chapter leaders for your vision and work.
At the same note,I regret for not being at DC after meeting some of the members yesterday.
Before, I have little/no idea of how to approach lawmakers (my idea of meeting lawmakers was like meeting politicians in INDIA, Zindhabad...Zindhabad type), glad i do now :rolleyes:!
Main concern/talk was about not many people turning up with 3000 IV members in the tristate, I strongly believe we can do much better in the number department for the next meeting. Again, not just numbers but with some motivation to take part in the events to come.
I did not like the leaders thanking the members just because they turned up! It should always the other way around, members should thank the leaders for organizing such events. After all it is for ones own benefit, no one is doing a fa�vour to any one!
Come on folks, join ur state chapters.

The Schedule A Workers category has become oversubscribed for November and a cut-off date established to hold number use within the 50,000 numerical limit. It is expected that demand will bring allocations up to the program limit during November. Once the limit is reached no further allocations will be possible, and the category listing will be removed from future cut-off date tables.
A PD for Schedule A category is for those people filing under EB2 with exceptional skills in arts and sciences . We had a post recently. Nurses and PT's do not have PD's as they do not have to file Labor Cert in the first place.

One big missing piece in your analysis - Country quota.
As per your analysis, there are around 125K pending cases. If there is no spill over (that is the case this year and that will be the case for the coming years as per State dept.), then EB3-I or EB2-I gets only 2700 visas per year.
Now, please redo your math and you can easily see that the current retrogress might look like there is hardly any retrogression.
This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?

I think you need a second opinion from a lawyer, no one here can really help you (unless he/she is a lawyer).
If your version of the story is really the absolute truth (assuming there is no wrong doing on your part) then you should fight, the system is fair (I'm sure people understand language barriers) and I'm sure judgment will be in your favor.
Just a word of caution... Don't underestimate the intelligence of people making the judgment, they deal with such cases everyday - they can easily smell a rat.
GC is not life, the trial verdict can change your life for better or for worse (specially if there is jail time involved).

With all due respect, the probelem I have with volunteers is that I don't think amtures can pull a job this big, you've got to have profesionals, somethng like a compain maneger.
I admire the courage of your guys, and think the goal is fantastic. But the way it goes, I don't see how it can be achieved.
I've learned a great deal about immigration from the forum here. I very much appreciate it. I try to give back by answering questions others may have. I think IV has been doing a great job serving as that capacity.
But you guys want do something bigger. Well, you have faith in it, I don't, at least not now, neither many others. Maybe that is why you are still asking for money and volunteers.

Is it possible to apply for both PIO and Indian visa simultaneously. My problem is that my son born in US has to go to India in 60days. If I apply for PIO and if it will not come in 4 weeks is it possible to apply for Indian visa and then go to India on Indian visa ?

Thank you all for all your suggestions and support. Past 3 days was very stressed and exhausted. Your suggestions and support made me relieved and courageous. Yesterday I slept peacefully without any tensions. IV is a great forum which is helping immigrants in difficult times by providing support and useful information. I am very thankful to you all. I will keep posting the updates; I will definitely fight and overcome this situation. Now, my first priority is my baby and health.
After seeing the support in IV, it proves that still there are so many good people out there to help people in difficult times. I won't forget this in my life.

Can you quote how this is addressing number 1 ?
AC 21 allows people to take on new positions as soon as they get H1 transfer receipt notice. How does this law address H1 transfer?
1) AC21 is used for H1B Transfer AND
2) AC21 is use for EAD (485 phase) Job change
This bill is addressing number 1 above NOT number 2. The above scenarios reflect the current system not the future merit based or whatever else. I am assuming a case where an applicant continues under the old system.
If anyone disagrees please substantiate.

On the other hand, if the I-485 denial is reaffirmed, then the USCIS could take the position that the EAD was not valid for employment authorization and the person worked without valid documents and, therefore, violated status and could be subject to removal. If one has an H1B petition approval, then there is some possible backup H1B status, in case the I-485 denial is reaffirmed. It also can depend upon the language in the I-485 denial, and whether there is a specific revocation of the EAD in the denial."

Your intentions are good - but the approach you took needs to be refined further. None of what I wrote above is personally against you - I appreciate your efforts but feel that we need to approach it differently - probably equating updates with money is not a good approach given that once someone gives money , they may start having a feeling of entitlement and we may not be ready to handle it.

Without a doubt, the poll I have posted is clearly focused on a single dimension i.e. whether receiving more regular updates will help people get more involved and contribute more (whatever be that amount, it would be in addition to current status). While there could be several other ideas to increase participation level, this is what I felt was important to me and was looking to gauge if others felt similalry. However, I clearly don't have a patent on ideas - if you have a different approach or idea I would assume you wouldn't hesitate to pursue that to achieve our goals.
As far as as the notion that someone who gives money feels entitled to receive information - so, what's wrong with that? After all no one gives without any expectations and based on this poll, there are at least some of us for whom being informed along the process is one of those expectations, especially since none of our goals will be achieved overnight. I do not mean generic updates of the nature you have cited, but more specific status reports of who is/has been doing what and what action, if any, is expected of the rest of us in order to support. If the organization is not prepared to handle that, I think it needs our help to be able to achieve that goal! Thanks! That's helpful... from what you say, sounds like PD is still quite important. RD comes into the picture only after the PD becomes current. However, if a range of PD's are current, then they would sort those by RD and not by PD.
For eg, if they move the dates forward by a year, and Jan 04 and Jan 05 are both now current, a person with PD of Jan 05 but an earlier RD would still get processed prior to an application with PD Jan 04 and a later RD (according to the FIFO principle)...
